Esta vez es el ministro de Justicia, Alberto Ruiz-Gallardón quien lo ha puesto de nuevo en la palestra, adelantando que se prohibirá abortar “por causas de malformación del feto”.
Naturalmente que todos los que aprobaron la actual legislación sobre el aborto, que llegó de la mano del Gobierno socialista hace dos años, han manifestado su descontento y oposición. Y tienen derecho a hacerlo y a defender sus posiciones.
Yo voy a dar mi opinión sobre el caso, teniendo en cuenta cuatro cosas: el sentido común (que tal vez sea el menos común de los sentidos, como se suele decir), las exigencias de mi conciencia, el respeto a la mujer y el derecho de legislar para la mayoría de la sociedad.
Todavía no conocemos los términos en que será promulgada la anunciada ley. Habrá que esperar para poder dar un juicio más certero. Creo que la fórmula “por causas de malformación del feto” es muy general, poco concisa, ambigua, y que se presta a equívocos. No es lo mismo una “malformación” secundaria que permita al nuevo ser llevar una vida humana y digna, aunque tenga alguna minusvalía, que aquellas malformaciones que hacen inviable una vida verdaderamente humana y digna.
Por otra parte, hay que tener en cuenta que el gobierno de un estado aconfesional (incluso aunque todos sus miembros sean confesionales y religiosos, debe legislar para todos, y no sólo para un grupo religioso o no. Siempre queda la conciencia y los criterios de las personas concretas (las mujeres) a la hora de abortar o no. De lo que se trata en la ley, a mi parecer, es de si debe o no ser penalizado el aborto en ciertas circunstancias. Se debe respetar la decisión responsable de las personas, aunque éticamente no se comparta. En consecuencia, mi parecer es que no debe penalizarse. Supongo, y no es mucho suponer, que para cualquier mujer, aunque no tenga principios religiosos o cristianos, es doloroso emocionalmente el tener que abortar, máxime si ese embarazo ha sido querido y deseado.
Mi conciencia, cristiana, pero también mis sentimientos humanos, me conduce a rechazar el aborto. Respeto a quien piense distinto; tendrán sus razones, y tienen también su conciencia. Pero también pido respeto a mis convicciones. Y no se me puede achacar de machismo, de ir contra los derechos de la mujer; no en vano tengo seis hermanas, y tuve una madre. Pero a pesar de ello, como ya he dicho, estoy en contra de la penalización. Que cada cual actúe según sus principios y su conciencia. Y repito que la “discapacidad” o “malformación” del feto, puede tener grados de gravedad o viabilidad de vida humana digna.
No me gusta esgrimir los “derechos” de la mujer en este caso, porque también tiene “derechos” el que puede nacer. Prefiero apelar a que cada persona, cada mujer, actúe según su conciencia y sus criterios. Eso sí que es un derecho y debe poder ejercerlo.
